Terms and Conditions
By subscribing to or using our Phone Booth as a Service Subscription Plan you agree to be bound by the following terms and conditions (“Terms & Conditions”).
Acceptance of Terms
These Terms & Conditions apply to all subscribers and users of our Subscription. By subscribing via email or signing this proposal, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
Subscription Plans and Pricing
We offer various subscription plans for renting our physical units, which remain our property, along with our team’s services to ensure seamless usage and direct customer support. The pricing for each plan is detailed on www.offcoustic.com/pricing or provided to you during the sales process. We reserve the right to change our pricing at any time, and any changes will be communicated to you in advance.
Mandatory Payment Commitment
Upon entering into a subscription agreement for our products, you are committing to a minimum payment obligation for the initial period of the contract, as specified in your subscription plan. This payment commitment is non-cancelable and non-refundable, except as provided in these Terms & Conditions or as required by law.
Setup and Removal Fees
A setup fee of €290 + VAT per unit will be charged for the shipping, assembly, and installation of each phone booth in your office. A removal fee of €290 + VAT per unit will be charged for the disassembly, transportation, and removal of each phone booth installed in your office.
Upgrades and Downgrades
After 24 months, subscribers may upgrade or downgrade their subscription plans. If upgrading, a new setup fee will apply, but the cancellation fee for the previous unit will be waived. If downgrading, the cancellation fee for the previous unit will apply, but the new setup fee will not apply.
Additionally, if subscribers choose to upgrade and sign a new contract after 36 months, both the setup fee for the new unit and the removal fee for the previous unit will be waived.
Cancellation Notice and Fees
A 2-month cancellation notice is required. If you cancel before the minimum commitment period, you will be charged 50% of the remaining contract value, plus the removal fee. If you cancel at the end of the contract term, you will be charged only the removal fee.
Payments and Billing
We accept payments through Stripe, debit or credit cards, and direct debit using your IBAN. You may also pay by SEPA transfer upon receiving our monthly invoice. For custom payment terms, refer to our Premium Package offerings.
Payment Disputes and Right of Removal
In the event of a payment dispute or non-payment, we reserve the right to remove the rented physical units from your premises, with reasonable notice. We will work with you to resolve any payment disputes or issues, but the right of removal is a necessary provision to protect our interests in our property.
- Setup fee will be charged upon receipt of the signed proposal.
- Cancellation fee will be charged upon your cancellation email.
Removal fee will be charged when the booth is removed.
Monthly Subscription charge will begin on the day the booth is installed in your office.
Limitation of Liability
In no event shall Offcoustic be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Products. This limitation of liability applies to the fullest extent permitted by law.
Warranty, Damage, and Insurance Policy
Our warranty, damage, and insurance policy is designed to provide our customers with peace of mind and a hassle-free experience while using our products. We understand that accidents and normal wear and tear may occur, and we offer clear coverage and defined liabilities for a range of incidents. We take care of everything so you can focus on your work.
Standard Warranty and Coverage:
We cover minor damages resulting from regular use, such as small scratches, scuffs, or marks.
We provide free repairs or replacements for broken materials, such as fans, electrical sockets, or lights.
Damage Repair and Replacement Costs:
In cases where damages are beyond normal wear and tear, the following charges will apply:
- Fabric Stain or Tear: Involves sending the panel to the factory for restoration; if uncleanable, the cost is 350€.
- Broken Glass: Door or ceiling, 350€.
- Carpet: Stains or damage that cannot be cleaned. Replacement cost is 290€.
- Broken Grilles: Grilles damaged by kicks, 75€.
- Table: Chipped, stained, and uncleanable, 120€.
- Switches and Sockets: scratched and with heavy usage marks, 50€.
- Lighting: Broken lamp, 80€.
Premium Plan Insurance:
Premium plan subscribers receive all-risk insurance coverage, which includes comprehensive protection against damages, ensuring that your liabilities are minimal. This coverage grants you peace of mind, as we take care of all necessary repairs or replacements for any damages that may occur.
Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of Portugal. Any disputes arising out of or in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of Portugal.
Changes to Terms & Conditions
We reserve the right to modify these Terms & Conditions at any time. Any changes will be posted on our website or communicated to you via email. Your continued use of our Subscription and Products after the changes have been posted constitutes your acceptance of the modified Terms & Conditions.
